El Convenio 149 de la Organización Internacional del Trabajo (OIT) hace un llamado a los Estados Miembros para que mejoren las leyes y reglamentos sobre seguridad y salud laboral y los adapten a la naturaleza particular del trabajo del personal de enfermería, plantea como objetivo principal la mejora de las condiciones laborales del personal de enfermería, integrado mayoritariamente por mujeres.

La progresiva pérdida de calidad de vida laboral, ya detectada en los años 70, llevó a la OIT a elaborar una norma específica que apostara por la toma en consideración de los auténticos problemas que identifican de modo específico el ejercicio de esta profesión.

La Asociación Paraguaya de Enfermeria ha luchado incansablemente por obtener una ley que regule el ejercicio de la profesión en el pais, lo ha logrado la promulgación y respectiva reglamentación y la puesta en vigencia en el 2007. En la normativa se contemplan mejoras de números como la carga horaria, la jubilación. Ya en el 2020 la Ley 6625 que establece la carrera Profesional de Enfermeria con esta normativa se podrá dar grandes avances, no obstante hay una gran brecha sobre las concocciones laborales mínimas para el equipo Enfermeria, como por ejemplo, la seguridad social. Más  del 70 % no cuenta con seguridad social, y un 50 % trabaja sin ninguna cobertura de salud.

A lo anterior, se suma la falta de pago por el turno nocturno, días festivos y feriados, contemplados en las normativas del pais. La pandemia hoy pone en un riesgo mayor, a la fecha se encuentran todas las enfermeras inmunizadas, se ha iniciado muy tarde la vacunación exponiendo a toda la primera línea a dar asistencia en condiciones de desprotección.

La crisis del COVID-19 plantea  enormes desafíos como oportunidades valiosas para dar forma a un futuro del trabajo más justo, inclusivo y seguro a través de la adopción y la ejecución efectiva de medidas políticas basadas en las normas internacionales del trabajo y el Estado de derecho. En ese sentido el convenio 149 debe ser uno de los objetivos.

Este Convenio reconoce la labor esencial del personal de enfermería en beneficio de la salud y el bienestar de la población. Además, establece normas laborales mínimas que regulan aspectos como las condiciones de trabajo, la adaptación de las normas que rigen la seguridad y la salud en el trabajo y el establecimiento de mecanismos de resolución de conflictos, entre otros, por eso, lograr su ratificación en el pais nos debe reunir a todas y todos.

La expansión  de  los  contagios  e  infecciones  asociados  al  coronavirus  enfatiza la urgente necesidad de contar con una fuerza laboral sólida, estable y bien remunerada en el sector de la salud, como parte integral de un sistema de salud eficaz y resistente. Pues en esta crisis, la falta de medidas de seguridad y de vacunas tempranas le ha costado la vida a muchas enfermeras –más que el promedio de enfermeras fallecidas en los países vecinos- razón por la cual nos hemos movilizado y demandado condiciones laborales dignas.

Se observa con imponentica algunos privilegios como los seguros VIP, gratificaciones y hasta aumentos de sueldo mientras tenemos un colectivo que desde hace se encuentra desarrollando su tarea en un contexto de alta vulnerabilidad sanitaria, social y económica.

Pero sin lugar a dudas, las enfermeras seguirán luchando y sacando fuerzas para resistir a la embestida de esta emergencia sanitaria y demandar de una vez por todas la ratificación del 149 de la OIT, que en tiempos de COVID podría salvar la vida de nuestras enfermeras y enfermeros.
