¿Qué es el Convenio 149 de la OIT?

El Convenio 149 que fue emitida por la Organización Internacional de Trabajo OIT que se refiere específicamente al trabajo de Enfermería es un instrumento legal de carácter legal internacional muy importante y valioso para las Enfermeras de los países, para mejorar tanto las condiciones laborales, como la educación de las mismas

Fue aprobado en 1977, pero para su real efectividad y aplicación en los países miembros y signatarios de la OIT debe ser ratificado por los Parlamentos nacionales de los países

En el Paraguay el Convenio 149 no ha sido ratificado aun por el Parlamento Nacional que de ser ratificado será de un aporte muy importante para mejorar las condiciones laborales y la educación de las Enfermeras

Por ello aunque la Enfermería en Paraguay cuenta con la Ley 3206 del Ejercicio de Enfermería  será muy importante emprender la lucha para que el Parlamento Nacional lo ratifique y se aplique en el país.

Aquí una breve reseña de los objetivos y contenidos del Convenio 149 de la OIT

La Conferencia General de la Organización Internacional del Trabajo:

Convocada en Ginebra por el Consejo de Administración de la Oficina Internacional del Trabajo, y congregada en dicha ciudad el 1 junio 1977 en su sexagésima tercera reunión;

Reconociendo el cometido esencial que, en colaboración con las demás categorías de personal de los servicios de salud, desempeña el personal de enfermería para la protección y mejoramiento de la salud y bienestar de la población;

Reconociendo que el sector público, como empleador de personal de enfermería, debería desempeñar un papel activo en el mejoramiento de las condiciones de empleo y de trabajo del personal de enfermería;

Observando que la situación actual del personal de enfermería en numerosos países del mundo, caracterizada por la escasez de personal calificado y una utilización a veces inadecuada del personal existente, constituye un obstáculo para el desarrollo de servicios de salud eficaces;

Recordando que el personal de enfermería está amparado por numerosos convenios y recomendaciones internacionales del trabajo que fijan normas de alcance general en materia de empleo y condiciones de trabajo, tales como los instrumentos sobre la discriminación, sobre la libertad sindical y el derecho de negociación colectiva, sobre la conciliación y el arbitraje voluntarios, sobre la duración del trabajo, las vacaciones pagadas y la licencia pagada de estudios, sobre la seguridad social y los servicios sociales, y sobre la protección de la maternidad y la protección de la salud de los trabajadores;

Considerando que, habida cuenta de las condiciones particulares en que se desempeña esta profesión, conviene completar las normas generales arriba mencionadas con otras especialmente aplicables al personal de enfermería y destinadas a garantizarle una condición que corresponda a su función en el campo de la salud y que reciba su aceptación;

Haciendo constar que las normas que figuran a continuación han sido elaboradas en colaboración con la Organización Mundial de la Salud y que esta colaboración se proseguirá a fin de promover y garantizar su aplicación;

La OIT adopta que dichas proposiciones revistan la forma de un convenio internacional,

adopta, con fecha veintiuno de junio de mil novecientos setenta y siete, el presente Convenio, que podrá ser citado como el Convenio sobre el personal de enfermería, 1977:

Artículo 1

  • A los efectos del presente Convenio, la expresión personal de enfermería comprende todas las categorías de personal que prestan asistencia y servicios de enfermería.
  • Este Convenio se aplica a todo el personal de enfermería, sea cual fuere el lugar en que ejerza sus funciones.
  • La autoridad competente, previa consulta con las organizaciones de empleadores y de trabajadores interesadas, cuando tales organizaciones existan, podrá adoptar disposiciones especiales para el personal de enfermería que presta asistencia y servicios de enfermería a título benévolo; tales disposiciones no deberán ser inferiores a las contenidas en el párrafo 2, a),

artículo 2 en los artículos 3, 4 y 7 del presente Convenio.

Artículo 2

  1. Todo Miembro que haya ratificado el presente Convenio deberá elaborar y poner en práctica, según métodos apropiados a las condiciones nacionales, una política de servicios y de personal de enfermería que, en el marco de una programación general de los servicios de salud, cuando ésta exista, y dentro de los recursos disponibles para el conjunto de estos servicios, tenga por objeto prestar tales servicios en la cantidad y calidad necesarias para asegurar a la población el mayor nivel posible de salud.
  2. En particular, tomará las medidas necesarias para proporcionar al personal de enfermería: a) una educación y una formación apropiadas al ejercicio de sus funciones; y b) condiciones de empleo y de trabajo, incluidas perspectivas de carrera y una remuneración, capaces de atraer y retener al personal en la profesión.
  3. La política mencionada en el párrafo 1 de este artículo deberá formularse en consulta con las organizaciones de empleadores y de trabajadores interesadas, cuando éstas existan.
  4. Dicha política deberá coordinarse con las relativas a los otros aspectos de la salud y a otras categorías de personal de los servicios de salud, en consulta con las organizaciones de empleadores y de trabajadores interesadas.

Artículo 3

  1. Las exigencias básicas en materia de instrucción y de formación de personal de enfermería y la supervisión de esta instrucción y de esta formación deberán ser previstas por la legislación nacional, o por las autoridades o los organismos profesionales competentes, habilitados al efecto por la legislación nacional.
  2. La instrucción y la formación del personal de enfermería deberán coordinarse con la instrucción y la formación proporcionadas a los otros trabajadores en el campo de la salud.

Artículo 4

La legislación nacional precisará las condiciones que deben reunirse para tener derecho al ejercicio de la práctica de enfermería y reservar este ejercicio a las personas que reúnan dichos requisitos.

Artículo 5

  1. Se tomarán medidas para fomentar la participación del personal de enfermería en la planificación de los servicios de enfermería y la consulta de este personal en la adopción de las decisiones que le afectan, según métodos apropiados a las condiciones nacionales.
  2. La determinación de las condiciones de empleo y de trabajo deberá realizarse, de preferencia, mediante negociaciones entre las organizaciones de empleadores y de trabajadores interesadas.
  3. La solución de los conflictos que plantee la determinación de las condiciones de empleo se tratará de lograr por medio de la negociación entre las partes o por medio de procedimientos independientes e imparciales, como la mediación, la conciliación o el arbitraje voluntario, cuyo carácter garantice la confianza de las partes interesadas.

Artículo 6

El personal de enfermería deberá gozar de condiciones por lo menos equivalentes a las de los demás trabajadores del país correspondiente, en los aspectos siguientes:

  1. horas de trabajo, incluidas la reglamentación y la compensación de las horas extraordinarias, las horas incómodas y penosas y el trabajo por turnos;
  2. descanso semanal;
  3. vacaciones anuales pagadas;
  4. licencia de educación;
  5. licencia de maternidad;
  6. licencia de enfermedad;
  7. seguridad social.

Artículo 7

Todo Miembro deberá esforzarse, si fuere necesario, por mejorar las disposiciones legislativas existentes en materia de higiene y seguridad del trabajo adaptándolas a las características particulares del trabajo del personal de enfermería y del medio en que éste se realiza.

Artículo 8

Las disposiciones del presente Convenio, en la medida en que no se apliquen por vía de contratos colectivos, reglamentos de empresa, laudos arbitrales, decisiones judiciales, o por cualquier otro medio conforme a la práctica nacional y que se considere apropiado, habida cuenta de las condiciones particulares de cada país, deberán ser aplicadas por medio de la legislación nacional.

Artículo 9

Las ratificaciones formales del presente Convenio serán comunicadas, para su registro, al Director General de la Oficina Internacional del Trabajo.

Artículo 10

  1. Este Convenio obligará únicamente a aquellos Miembros de la Organización Internacional del Trabajo cuyas ratificaciones haya registrado el Director General.
  2. Entrará en vigor doce meses después de la fecha en que las ratificaciones de dos Miembros hayan sido registradas por el Director General.
  3. Desde dicho momento, este Convenio entrará en vigor, para cada Miembro, doce meses después de la fecha en que haya sido registrada su ratificación.

Artículo 12

El Director General de la Oficina Internacional del Trabajo notificará a todos los Miembros de la Organización Internacional del Trabajo el registro de cuantas ratificaciones, declaraciones y denuncias le comuniquen los Miembros de la Organización.

Artículo 13

El Director General de la Oficina Internacional del Trabajo comunicará al Secretario General de las Naciones Unidas, a los efectos del registro y de conformidad con el artículo 102 de la Carta de las Naciones Unidas, una información completa sobre todas las ratificaciones, declaraciones y actas de denuncia que haya registrado de acuerdo con los artículos precedentes.
